What should I do if I am injured in an automobile accident?
Call a lawyer immediately. All lawyers take these cases on a contingent fee basis so it won’t cost you anything. You must speak with a lawyer who will represent your interests before someone from the other side speaks with you. You will be at a great disadvantage if you act without a lawyer on your side.
What is a contingent fee?
A contingent fee is one that is payable only if there is a recovery. Most contingent fees provide the lawyer with 1/3 or 33% of the amount recovered. If there is no recovery, generally there will be no fee due to the lawyer.
Is there a fee for a consultation?
Initial consultations and all fees in auto accident cases are contingent in my office. No up front fees are charged and no legal fees at all if there is no recovery.
Will I have to go to trial?
That is up to you as the client. Most cases can be settled for a reasonable recovery. But if you expect too much, or the other side takes a hard position, the case may have to be tried to get a resolution. I do not believe that the decision to go to trial should be made by the lawyer, rather the client, after considering all relevant factors and with full knowledge of the possible outcomes. I never force my clients to go to trial.
If I am not at fault, can I still be sued?
It is possible. Sometimes the party not at fault can be sued first, thereby creating the appearance of negligence or fault. Without a lawyer to represent you, you will be at a distinct disadvantage.
